KEGEL On-line Privacy NOTICE

This Privacy Notice (“Privacy Notice”) describes how KEGEL (“KEGEL,” “we,” “us,” or “our”) collects, uses, and discloses information associated with an identified or identifiable individual (“Personal Information”). This Privacy Notice applies to all KEGEL-owned and operated digital properties, including: (a) kegel.net and all affiliated websites listed in Section 7 (collectively, the “Websites”); (b) the KEGEL Smart Link mobile application (the “App”); and (c) the Smart Link connected-product platform and all related products and services (collectively with the Websites and the App, the “Services”). KEGEL is a limited liability company organized under the laws of the State of Florida, United States.

Commitment to Limited Collection.

 We only collect Personal Information that is adequate, relevant, and limited to what is necessary for the purposes described in this Privacy Notice. We regularly review our data collection practices to ensure compliance with this principle. If you believe we have collected Personal Information beyond what is necessary, please contact us at privacy@kegel.net.

1. WHAT INFORMATION WE COLLECT.

Personal Information we collect may include:

Account Information. Username, password, Kegel Smart ID credentials, account or membership number, and other internal identifiers associated with your use of our Websites, App, or Services.

Identifying Information. Name, email address (personal or business), and date of birth.

Contact Information. Address (home, work, mailing, shipping/billing), email address, and phone number.

Marketing Preferences. Opt-in/opt-out signals, consent records, and communication preferences.

Employment-Related Information. Job title, role, employer, department, and work contact information (current or past).

Commercial and Transaction Information. Records of products or services purchased, obtained, or considered, including order history, warranty registrations, subscription or membership status, and invoices.

Behavioral and Advertising Data. Tracking data via cookies and pixels.

Device Information. Device model, type, operating system version, browser type, network provider, time zone, language, screen resolution, advertising ID, unique device identifiers (IMEI, MAC address), and IP address.

Client and Log Data. Access logs (login attempts, password changes, failed logins) and interactions with our Websites and App (download errors, crash logs).

Usage Information. Pages visited, time and duration of visit, navigation path, referring URL, exit pages, clicks, ad engagement, email interactions (opens and clicks), clickstream data (cookies, beacons, pixels, SDK tags), cookie preferences, browsing history, and search history.

Connected-Product Operational Data. Information automatically collected from KEGEL lane machines (Atlas, Flex, Ikon models) equipped with Smart Link technology, including: serial numbers, QC numbers, battery serial numbers, firmware versions, valve times, run times, error logs, operating status, and IP addresses.

Connected-Product User-Inputted Information. Names entered at registration, usernames identifying machine operators, and technician identifiers entered into KEGEL lane machines or the Smart Link platform.

Location Information (Connected Products). State/province and country based on information provided at the time of machine registration. We collect geolocation or GPS data from your connected product each time it is powered on. Connected products do not transmit geolocation or GPS data while the products are in use.

Communications. Information you provide when you contact us by phone, mail, text, email, web form, social media, or other method. All Personal Information in such communications is processed in accordance with this Privacy Notice.

Other Necessary Information. Other data, including Personal Information, where we are required or permitted by applicable law to collect it for authentication, identification, or verification purposes.

2. HOW WE COLLECT YOUR PERSONAL INFORMATION

We collect Personal Information in the following ways:

From You. We collect Personal Information when you voluntarily provide it, such as when you contact us, register for access to our Services, create a Kegel Smart ID account, register a lane machine, purchase products or services, or interact with our distributors. We collect the following categories of Personal Information directly from you: account information; identifying information; contact information; employment-related information; commercial and transaction information; connected-product user-inputted information; location information; communications; and sensitive information.

Automatically When You Use Our Websites, App, or Services. When you interact with our Services, we automatically collect the following categories of information about you: account information; identifying information; device information; client and log data; usage information; and behavioral and advertising data.

We use cookies as part of automatic collection. “Cookies” are small text files transferred to your device that may collect data such as visit date and time, browsing history, preferences, and username. You can set your browser to reject cookies, but doing so may affect the availability and functionality of our Services.

Automatically from Connected Products (Lane Machines and Smart Link Platform, including Atlas, Flex, and Ikon models). When a KEGEL lane machine equipped with Smart Link technology is connected to the internet, the machine automatically transmits Operational Data to KEGEL’s cloud platform. This data includes serial numbers, QC numbers, battery serial numbers, firmware versions, valve times, run times, error logs, operating status, and IP addresses. This data is collected passively and does not require affirmative action by the machine operator beyond the initial registration and connection. For more details, see Section 4 (Connected-Product Technology and Data Practices) below.

From Other Sources. We may collect information from third parties, including our authorized distributors, advertising and marketing partners, public databases, and industry partners.

Sensitive Personal Information. We do not collect sensitive Personal Information as part of our business.

3. HOW WE USE YOUR PERSONAL INFORMATION

We process Personal Information only for the purposes described in this Privacy Notice or for compatible purposes. Before using Personal Information for a materially different purpose, we will notify you and, where required by applicable law, obtain your consent. Contact us at privacy@kegel.net with any questions.

 We use your Personal Information to operate, provide, maintain, develop, and promote our Services, as permitted by law, for the following business purposes:

To Provide You with the Services. This includes operating and maintaining the Services; providing user support; fulfilling or meeting the reason you provided the information (e.g., processing orders, providing product information, delivering lane machine diagnostic support); and creating and maintaining your user account (including your Kegel Smart ID). Categories used: account information; identifying information; contact information; commercial and transaction information; connected-product operational data; connected-product user-inputted information; device information; client and log data; and usage information.

To Process Payments and Perform Financial Transactions. This includes processing, completing, and administering payment card and other financial transactions related to product purchases, training services, and subscriptions. Categories used: account information; identifying information; contact information; and commercial and transaction information.

To Communicate with You. This includes responding to your comments, inquiries, and requests; providing user support and customer care; sending administrative communications such as confirmation emails, technical notices, policy updates, or security alerts; and soliciting user feedback, reviews, survey responses, and product evaluations. Categories used: account information; identifying information; contact information; device information; client and log data; and usage information.

To Send You Marketing and/or Promotions. This includes sending you promotional information, including newsletters, product announcements, and advertisements from our affiliates and on behalf of our promotional and strategic partners; and notifying you of new products, services, training programs, or events that may be of interest to you. Categories used: account information; identifying information; contact information; marketing preferences; device information; client and log data; and usage information.

For Analytics, Research, and Product and Service Improvements. This includes tracking and measuring the performance of our Services; conducting aggregated or de-identified research and statistical reporting for business purposes; analyzing connected-product data for product improvement, predictive maintenance, and research and development purposes; and performing quality control. Categories used: account information; identifying information; connected-product operational data; device information; client and log data; and usage information.

For Connected-Product Diagnostics and Support. This includes using Operational Data and User-Inputted Information from KEGEL lane machines for diagnostics and troubleshooting, technical support, product improvement, analytics, predictive maintenance, research and development, and distributor reporting. See Section 4 for additional details.

For Personalization. This includes our efforts to improve your experience with our Services by providing a personalized experience and reviewing the effectiveness of our marketing. Categories used: account information; identifying information; contact information; device information; client and log data; and usage information.

To Ensure the Security and Integrity of the Services. This includes securing our systems, protecting our business, our employees, and you by preventing, detecting, investigating, and securing against unauthorized or illegal activity and other security-related technical issues. Categories used: account information; identifying information; contact information; device information; client and log data; and usage information.

To Comply with the Law and Enforce Our Terms. This includes the use of Personal Information as we believe to be necessary or appropriate for certain essential purposes, including: meeting our legal or regulatory obligations; complying with valid legal process; protecting rights, safety, and property; detecting, preventing, or investigating security incidents, data breaches, or fraud; and enforcing our Terms of Service, Connected-Product Terms of Use, and all other applicable terms and policies. Categories used: account information; identifying information; contact information; commercial and transaction information; connected-product operational data; device information; client and log data; and usage information.

For Other Business Purposes. This includes sharing Personal Information with service providers, contractors, business partners, affiliates, and parent/subsidiary companies for business-related functions; managing and maintaining ongoing relationships and contracts (including distributor, vendor, and customer relationships); and executing business transfers (mergers, sales, acquisitions, bankruptcy, or dissolution). Categories used: account information; identifying information; contact information; employment-related information; commercial and transaction information; connected-product operational data; device information; client and log data; and usage information.

4. CONNECTED-PRODUCT TECHNOLOGY AND DATA PRACTICES

KEGEL manufactures lane maintenance machines (including the Atlas, Flex, and Ikon models) that incorporate connected-product technology through the Smart Link cloud platform, embedded firmware, and the KEGEL Smart Link mobile application. This section describes how we collect, use, store, and share data in connection with these connected products.

Data Collected Automatically (Operational Data).

When a KEGEL lane machine is connected to the internet and registered on the Smart Link platform, it automatically collects and transmits the following Operational Data to KEGEL’s cloud infrastructure: serial numbers, QC (quality control) numbers, battery serial numbers, firmware versions, valve times, run times, error logs, operating status, and IP addresses.

This data is transmitted passively and continuously while the machine is connected to the internet. Collection does not require ongoing affirmative action by the operator beyond initial registration and network connection.

User-Inputted Information.

In addition to automatically collected Operational Data, the following information is entered by users during registration and use of the SmartLink platform and KEGEL lane machines: names entered at registration, usernames identifying machine operators, and technician identifiers.

Location Information.

KEGEL collects location information limited to the state/province and country entered at the time of machine registration. We collect location data from certain machines each time they are powered on. This location data is not continuously monitored or tracked while the machines are in use. No continuous location tracking of machines occurs.

How We Use Connected-Product Data.

KEGEL uses data collected from connected products for the following purposes:

1.         Diagnostics and troubleshooting;

2.         Technical support

3.         Product improvement;

4.         Analytics (aggregated usage and performance data);

5.         Predictive maintenance;

6.         Research and development; and

7.         Distributor reporting (as described below)

Distributor Data Sharing.

Distributor data sharing begins immediately at the time of machine registration of a KEGEL lane machine. KEGEL shares certain information with its authorized distributors for the purposes of proactive maintenance outreach, parts replacement support, and warranty service. The information shared with distributors includes:

1.         Bowling center name(s);

2.         Contact name(s);

3.         Phone number(s); and

4.         Expired part information

KEGEL’s authorized distributors are contractually prohibited from using this data for marketing non-KEGEL products, sharing it with third parties, or soliciting customers for competing products. Distributors are bound by confidentiality and data-handling obligations under KEGEL’s Distribution Agreement.

Your Right to Opt Out of Distributor Data Sharing.

You have the right to opt out of the sharing of your information with KEGEL’s authorized distributors as described above. To exercise this right, you must contact KEGEL in writing at the address provided in Section 15 (Contact Us).

This opt-out right is provided under KEGEL’s Connected-Product Terms of Use. Please note that opting out of distributor data sharing may affect KEGEL’s ability to provide proactive maintenance and warranty services through your local distributor.

Cloud Hosting and Cross-Border Data Transfers.

KEGEL’s connected-product cloud services are hosted on cloud-based servers located in the following regions: United States, European Union, Republic of Korea (South Korea), and Japan.

The primary data storage location for your connected-product data depends on the geographic region in which your machine is registered. However, data may be replicated across KEGEL’s global server infrastructure for redundancy, performance, and business continuity purposes. As a result, cross-border data transfers occur as part of the normal operation of the KEGEL’s platform. Where required by applicable law, we rely on appropriate legal mechanisms (such as Standard Contractual Clauses, adequacy decisions, or your consent) to authorize these transfers. See Section 11 (Additional Information for Certain Jurisdictions) for more information.

KEGEL Smart Link Mobile Application.

The KEGEL Smart Link mobile application (available on iOS and Android) provides an interface for monitoring and managing KEGEL lane machines. The App collects and transmits the same categories of Operational Data and User-Inputted Information described above. By using the App, you acknowledge and consent to the data practices described in this Privacy Notice.

5. COOKIES AND TRACKING TECHNOLOGIES

We and our third-party service providers use cookies, pixels, web beacons, scripts, and similar tracking technologies (collectively, “Tracking Technologies”) on our Services to collect information about your interactions with us. For detailed information about the cookies we use and how to manage your preferences, please see our Cookie Notice below.

What Are Cookies?

Cookies are small text files placed on your device by a web server. They help us recognize your browser, remember your preferences, and understand how you use our Websites. Some cookies are “session” cookies that expire when you close your browser; others are “persistent” cookies that remain until you delete them or they expire.

Categories of Cookies We Use.

We use the following categories of cookies on our Services:

You can control cookies through your browser settings. Most web browsers allow you to refuse or delete cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Services.

Cookie Consent Banner and Privacy Preference Center. When you first visit our Services, you will be presented with a cookie consent banner (powered by Cookiebot/Usercentrics) that allows you to accept or reject non-essential cookies. You can change your cookie preferences at any time through our cookie consent management tool, accessible via the cookie settings link in the footer of our websites or by visiting kegel.net/privacy.

Analytics.

We use various analytics providers across our Services, which may include Google Analytics, Squarespace, Shopify, JotForms, Lucky Orange, and other third-party analytics tools. The specific analytics providers used on each website may vary and are subject to change. For the most current list of analytics providers, please review the cookie table available at kegel.net/privacy or through our cookie consent management platform.

6. HOW AND TO WHOM WE DISCLOSE PERSONAL INFORMATION

We may disclose Personal Information in certain circumstances as part of our general business practices. This section discusses those circumstances.

Disclosures for Business Purposes. To the extent permitted by law, your Personal Information may be disclosed to the following categories of third parties:

Authorized Distributors. As described in Section 4 above, we share certain connected-product data and customer information with our authorized distributors for proactive maintenance, parts support, and warranty service. Distributors are contractually bound to use this information solely for KEGEL-authorized purposes and are prohibited from using it for marketing non-KEGEL products, sharing it with third parties, or soliciting for competing products.

Business Transfers. If we sell or transfer all or part of our business assets, Personal Information may be included. We will take reasonable steps to ensure that any transferred Personal Information receives protection equal to or greater than that provided by this Privacy Notice. In the event of such a transfer, you are encouraged to contact the recipient with any questions about their privacy practices.

Agents, Consultants, and Related Third Parties. For business-related functions (such as mailings, database maintenance, and payment processing), we may share Personal Information with third parties, but only to the extent necessary to perform their designated function.

When Legally Required. We may share Personal Information with law enforcement authorities, regulators, courts and tribunals, governmental or public bodies, and other relevant third parties as we believe necessary or appropriate to protect people or property, to protect our services, rights or property, to comply with legal or regulatory requirements, and to respond to legal process, law enforcement requests, and requests from other public and government authorities.

Third-Party Vendors. We share Personal Information with vendors and service providers. Each third-party vendor’s privacy notice explains their use of your Personal Information. These include the following categories of vendors:

General Service Providers: We use third-party vendors to provide operational, administrative, technical, professional, and customer-facing services that support our business. These vendors may process Personal Information to help us operate our services, manage customer relationships, respond to requests, maintain records, improve our offerings, and perform other services on our behalf.

Cloud, Hosting, and Infrastructure Providers: We use cloud services to host our connected-product platform and certain website infrastructure. These providers may store, process, secure, and transmit data, including Personal Information, on our behalf.

Analytics Providers: We use third-party vendors to help us understand how individuals interact with our Websites, App, products, services, communications, and advertisements. These vendors may collect or process device information, usage information, cookies, pixels, IP addresses, browser information, and similar information to measure performance, troubleshoot issues, and improve user experience.

Payment Processors and Financial Institutions: We use third-party vendors to process payments, refunds, credits, and other financial transactions. These vendors may process payment-card information, bank account information, billing information, transaction details, authentication data, and related payment records.

E-Commerce Platform (Shopify): Our Fizzion consumer products website (fizzionclean.com) uses the Shopify platform to process e-commerce transactions. Shopify may collect and process Personal Information in connection with product orders, payments, shipping, and account management. Shopify’s use of your data is governed by Shopify’s privacy policy in addition to this Privacy Notice.

Other Third Parties.

We may send your Personal Information to third parties at your direction or with your consent.

Sale and “Sharing” of Personal Information.

We do not sell your Personal Information to third parties in exchange for monetary compensation. However, we may disclose certain categories of Personal Information to third parties, such as our affiliates and business partners. These third parties may receive other valuable consideration or benefit from the use of the disclosed information, which may qualify as a “sale” or “sharing” of Personal Information as those terms are defined under the CCPA and other applicable U.S. state privacy laws.

Categories of Personal Information that may be disclosed in this manner include: identifiers and contact information; and online and technical information.

You have the right to opt out of such sales and sharing. To exercise this right, please submit a request pursuant to Section 8 of this Privacy Notice. We also honor browser-based opt-out preference signals, such as the Global Privacy Control (“GPC”), as required by applicable law. Certain cookie-related preferences may be managed directly through our cookie consent management tool, accessible via the cookie settings link on our website.

Disclosure of Other Information.

In addition to Personal Information, we may collect information that does not identify you and is not associated with your Personal Information. We may also de-identify, anonymize, or aggregate information so it no longer identifies you. When we use or disclose de-identified information, we maintain it in de-identified form, do not attempt to re-identify it unless permitted by law, and require recipients to do the same through contractual agreements.

Legal Basis for Processing Your Personal Information.

Some jurisdictions require that companies tell you about the legal grounds that allow your data to be used or disclosed. Below are the types of lawful bases that we will rely on to process your Personal Information:

Legitimate Interest. We may process your Personal Information where we have a legitimate interest in conducting and managing our business to enable us to provide you with the best service, products, and a secure experience. We balance the potential positive and negative impacts on you and your rights. If the impact on your rights outweighs our legitimate business interests, we do not use or disclose your Personal Information without your consent, unless required or permitted by law. You can obtain further information about how we evaluate our legitimate interests against any potential impact on you for specific activities by contacting us at privacy@kegel.net.

Performance of Contract. We may process your Personal Information where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply With a Legal or Regulatory Obligation. We may process your Personal Information where it is necessary for compliance with a legal or regulatory obligation.

Consent. You have given express permission for a particular use of your Personal Information. Where we rely on your consent as the legal basis for processing your Personal Information, you may withdraw your consent at any time by submitting a request pursuant to Section 8 of this Privacy Notice. or by contacting us at privacy@kegel.net.

Legitimate Interest Assessments. Where we rely on legitimate interests as our legal basis for processing your Personal Information, we conduct and document legitimate interest assessments (“LIAs”) to ensure that our interests do not override your fundamental rights and freedoms. These assessments consider: (i) the nature and purpose of the processing; (ii) the potential impact on you, including any risks to your privacy; (iii) whether you would reasonably expect the processing; (iv) the relationship between you and KEGEL; and (v) any safeguards we can implement to minimize any negative impact on you. You may request further information about how we have balanced our legitimate interests against your rights by contacting us at privacy@kegel.net.

7. KEGEL AFFILIATED WEBSITES

This Privacy Notice applies to all KEGEL-owned and operated websites listed below. Each website may have different functionality (e.g., login portals, e-commerce), but all are governed by this Privacy Notice unless otherwise noted:

  1. kegel.net — KEGEL’s main corporate website for lane machines, lane supplies, and pinsetter parts. 

  2. distributors.kegel.net — Portal for KEGEL bowling distributors (requires Kegel Smart ID login).

  3. luckystrike.kegel.net — Portal for Lucky Strike Entertainment customers and employees (requires Kegel Smart ID login).

  4. patternlibrary.kegel.net — KEGEL’s oil pattern library for lane machine patterns (optional Kegel Smart ID login).

  5. kegelmechanicsklub.com — Educational resource hub for pinsetter and lane machine mechanics (requires approved Kegel Smart ID login).

  6. kegeltrainingcenter.com — Website for the Kegel Training Center bowling training facility, offering lessons, camps, and coaching programs. Accepts online payments via PayPal or Clover.

  7. spectobowling.com — Product site for SPECTO, KEGEL’s bowling ball tracking and practice system. 

  8. qubicaamfsupplies.com — Co-branded site for QubicaAMF lane care and supplies products.

  9. kegelmfg.com — Site for Kegel Contract Manufacturing, offering chemical processing and private label production services.

  10. fizzionclean.com — Consumer site for Fizzion household cleaning products. This is the only KEGEL website with e-commerce checkout (hosted on Shopify). Shopify’s privacy policy applies to transactions in addition to this Privacy Notice.

Note: kegelgear.com is NOT owned or operated by KEGEL. It is an independent third-party distributor website.

8. YOUR RIGHTS RELATED TO YOUR PERSONAL INFORMATION

We provide several ways for you to exercise certain privacy choices about your Personal Information that we process. We are committed to respecting your privacy rights under all applicable data protection and privacy laws. Some privacy laws require us to give specific details about individual rights to consumers, which we have set forth in Section 14 of this Privacy Notice.

Marketing.

You may opt out of marketing-related communications from us at any time by contacting us through the contact information provided in this Privacy Notice or by using the unsubscribe mechanism contained in each email. We will make efforts to honor your request as soon as reasonably possible. Please note that even if you opt out of marketing emails, we may still send you important administrative messages, which you cannot opt out of.

Cookies Preferences.

You can manage your cookie preferences through our cookie consent banner (powered by Cookiebot/Usercentrics), which appears when you first visit our websites. You can also change your preferences at any time by visiting the cookie settings link in the footer of our websites or by visiting kegel.net/privacy.

Distributor Data Sharing Opt-Out.

You may opt out of the sharing of your information with KEGEL’s authorized distributors (as described in Section 4) by contacting KEGEL in writing at the address provided in Section 15 (Contact Us).

Access, Amendment, and Deletion.

Under applicable privacy laws, you may have the right to request to review, make amendments, have deleted, or otherwise exercise your rights over your Personal Information that we hold, subject to certain legal limitations and requirements. If you are subject to such a privacy law, you may submit a request to us related to your Personal Information through our Privacy Preference Center or by using the contact methods below:

1.         By submitting an email request to us at privacy@kegel.net.

2.         By mailing a request to the address provided in Section 15 (Contact Us).

For data deletion requests specifically:

1.         By submitting an email request to us at privacy@kegel.net, or by mailing a request to the address provided in Section 15 (Contact Us), directed to Attn: IT / Data Deletion.

We will process any request in accordance with, and where required by, applicable law with respect to your Personal Information. We will take steps to verify your identity before implementing your request. We do not charge a fee to process or respond to your verified consumer request unless it is excessive, repetitive, manifestly unfounded, or otherwise creates a burden in excess of standard requests, or is prohibited by law. If we determine that the request warrants a fee, we will inform you and provide a written justification and cost estimate before proceeding.

We take reasonable steps to ensure that the Personal Information we hold is accurate, complete, and up-to-date. We rely on you to provide accurate Personal Information and to notify us of any changes. If you become aware that Personal Information we hold about you is inaccurate, incomplete, or outdated, please contact us at privacy@kegel.net so that we can take appropriate steps to correct or update the information.

Time for Changes to Take Effect.

We aim to complete requests as soon as reasonably practicable, consistent with applicable laws. Requests made on behalf of another, which require confirmation of the agent’s authority and the authenticity of the requester, will likely take more time to complete.

We may need to retain certain information for recordkeeping purposes and to complete transactions you began before requesting a change or deletion. Some residual information may remain in our databases and will not be removed. We may not always be able to fully comply with your request, particularly if doing so would compromise our duty of confidentiality or if we are legally permitted to handle the request differently.

9. SECURITY, RETENTION, AND BREACH NOTIFICATION

Security of Personal Information.

KEGEL does not knowingly collect Personal Information from children under 18. Our Services are directed at businesses, bowling center operators, and adult consumers and are not intended for use by children. We encourage parents and legal guardians to monitor their children’s Internet activity and to instruct their children never to provide Personal Information on any website without parental permission. If a parent or guardian believes that KEGEL holds Personal Information about a child under 18, please contact privacy@kegel.net immediately. We will take steps to promptly remove such information.

We are not responsible for the privacy and data security practices of other organizations, such as Facebook, Instagram, Apple, Google, Microsoft, X, Shopify, PayPal, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer. 13. DO NOT TRACK, GPC, AND OPT-OUT SIGNALS

Do Not Track. We do not monitor or follow “Do Not Track” (DNT) signals because there is no standard interpretation or practice for DNT signals. Therefore, we handle all user information consistent with this Privacy Notice.

Reservation of Rights. International Data Transfers. KEGEL is headquartered in the United States.
